By accessing or using our website, you agree to these Terms. If you do not agree with these Terms, please do not use the website.

These Terms should be read together with our Privacy Policy and HIPAA Notice of Privacy Practices, which are incorporated into and form part of our overall website and privacy practices.

1. USE OF OUR WEBSITE

Our website is intended to provide general information about Backcountry Dental, our dental professionals, our services, our office, and ways to contact us.

You agree to use the website only for lawful purposes and in a manner that does not:

  • Violate applicable federal, state, or local laws;

  • Infringe the rights of another person;

  • Attempt to gain unauthorized access to our systems;

  • Interfere with the operation or security of the website;

  • Introduce malicious software, code, or other harmful material;

  • Scrape, copy, reproduce, or systematically collect website content without our permission; or

  • Misrepresent your identity or your relationship with Backcountry Dental.

We reserve the right to restrict or terminate access to the website when we reasonably believe that these Terms have been violated or that such action is necessary to protect our website, patients, staff, or other users.

2. INFORMATION ON THIS WEBSITE IS GENERAL INFORMATION

The information provided on this website is intended for general educational and informational purposes.

Although we make reasonable efforts to provide useful and accurate information, website content may not always reflect the most current dental research, treatment recommendations, laws, regulations, technology, or clinical practices.

Website information should not be considered a substitute for an examination, diagnosis, consultation, or individualized advice from a qualified dental professional.

You should not make decisions about your dental health or treatment solely on the basis of information contained on this website.

3. NO DENTIST-PATIENT RELATIONSHIP CREATED BY WEBSITE USE

Using this website, reading information on the website, submitting a general contact form, sending an inquiry, requesting an appointment, or communicating with Backcountry Dental electronically does not by itself establish a dentist-patient relationship.

A dentist-patient relationship is established only through an appropriate clinical relationship with Backcountry Dental in accordance with our practice procedures and applicable law.

We may decline to establish a dentist-patient relationship when clinically or otherwise appropriate.

4. DENTAL AND MEDICAL DISCLAIMER

Information on this website may discuss dental conditions, procedures, treatments, medications, oral health, and other healthcare topics.

Such information is provided for educational purposes only.

Nothing on this website should be interpreted as:

  • A diagnosis of your dental or medical condition;

  • Individualized medical or dental advice;

  • A recommendation that a particular treatment is appropriate for you;

  • A guarantee of a particular treatment result;

  • A substitute for an in-person dental examination; or

  • A substitute for professional medical or dental care.

Treatment recommendations depend on an individual's circumstances, medical and dental history, examination findings, diagnostic information, treatment goals, and other factors.

Only a qualified dental professional who has evaluated you can determine whether a particular treatment is appropriate.

5. DENTAL EMERGENCIES

DO NOT USE THIS WEBSITE, EMAIL, TEXT MESSAGES, OR ONLINE APPOINTMENT REQUESTS FOR DENTAL EMERGENCIES.

Our website and electronic communications are not continuously monitored and may not be appropriate for urgent or emergency communications.

If you are experiencing a dental emergency, contact Backcountry Dental directly at (435) 649-6332 if our office is open.

If you are experiencing a serious or potentially life-threatening medical emergency, call 911 or seek immediate care at the nearest emergency department.

Examples of situations requiring urgent evaluation may include significant facial swelling, difficulty breathing or swallowing, uncontrolled bleeding, serious facial trauma, loss of consciousness, or other symptoms that may represent a medical emergency.

Do not wait for a response to an online form, email, or text message when immediate care is needed.

6. APPOINTMENT REQUESTS

Our website may allow you to contact us or request an appointment.

Submitting an online appointment request does not guarantee that an appointment has been scheduled.

An appointment is not confirmed until Backcountry Dental or an authorized scheduling service confirms the appointment.

We may contact you by telephone, text message, email, or another permitted communication method to respond to an appointment request.

You are responsible for providing accurate contact information and checking communications from our office regarding appointment requests.

If you need to cancel or change an appointment, please contact our office as soon as possible.

Our separate office policies concerning cancellations, missed appointments, deposits, or other scheduling matters may apply.

7. ONLINE SCHEDULING

If Backcountry Dental adds online scheduling to the website, the scheduling service may be provided through a third-party platform.

Online scheduling availability does not guarantee that a particular appointment, provider, procedure, or treatment will be available.

Backcountry Dental reserves the right to modify or cancel appointment availability when reasonably necessary.

Additional terms or privacy policies of the scheduling provider may apply to your use of the scheduling service.

8. ONLINE PAYMENTS

If Backcountry Dental provides online payment functionality, payments may be processed through a third-party payment service.

Payment information may be collected and processed directly by the applicable payment provider.

Backcountry Dental does not intend to store complete payment-card information on its website unless specifically stated otherwise.

You are responsible for providing accurate payment information and for reviewing any applicable terms and privacy policies of the payment provider.

Online payment functionality does not modify or replace any financial policies, payment agreements, insurance obligations, or balances applicable to your account.

Please do not rely on a text message to obtain immediate medical or dental assistance.

We may not monitor text messages continuously, and response times may vary.

For urgent concerns, contact our office directly. For a medical emergency, call 911.

Patient-initiated text messages

If you voluntarily send a text message to Backcountry Dental, you understand that information contained in that message may become part of your communications with our practice and may be handled as protected health information when applicable.

Please avoid sending highly sensitive information by text unless our office specifically asks you to do so.

The number of text messages you receive will vary depending on your appointments, communications with our office, and the services you use.

Message and data rates

Re-subscribing

If you later wish to resume text communications, contact our office and we will assist you where available and permitted.

Consent and communication preferences

By providing a mobile telephone number to Backcountry Dental and requesting or accepting text communications, you acknowledge that we may use that number for permitted communications related to your care, appointments, and practice administration.

Where separate consent is required for marketing or promotional text messages, we will obtain that consent separately.

You are not required to agree to receive marketing text messages as a condition of receiving dental care.

10. ELECTRONIC COMMUNICATIONS AND PRIVACY

Email, text messaging, and other electronic communications may involve privacy and security risks.

Backcountry Dental will use reasonable safeguards appropriate to the communication method.

Patients may request reasonable alternative methods or locations for receiving communications concerning their health information, consistent with applicable law.

Our HIPAA Notice of Privacy Practices explains your rights regarding confidential communications and protected health information.

For more information, please contact our office at office@backcountrydentalut.com

11. WEBSITE FORMS

Our website may provide forms that allow you to contact Backcountry Dental or request an appointment.

Submitting information through a website form does not guarantee that we will respond immediately.

Please do not use general website forms to submit information about a dental emergency or other matter requiring immediate attention.

You should also avoid including unnecessary sensitive medical or dental information in general website forms.

Information submitted through our website is handled in accordance with our Privacy Policy and, where applicable, our HIPAA privacy practices.

16. NO GUARANTEE OF TREATMENT RESULTS

Dental treatment outcomes vary from person to person.

Photographs, testimonials, before-and-after examples, descriptions of treatment outcomes, and other information appearing on our website are provided for illustrative or educational purposes.

They should not be interpreted as a promise, warranty, or guarantee that you will experience the same or similar result.

17. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the website and its content are provided on an "as is" and "as available" basis.

Backcountry Dental makes no warranties, express or implied, concerning the website or its content, including warranties of accuracy, reliability, availability, fitness for a particular purpose, or non-infringement, except to the extent that such warranties cannot legally be excluded.

Nothing in these Terms is intended to exclude or limit any right, remedy, or protection that cannot lawfully be excluded or limited.

18. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Backcountry Dental and its owners, dentists, employees, contractors, and service providers will not be liable for damages arising from or related to your use of, or inability to use, the website or reliance on information contained on the website.

This includes, to the extent permitted by law, indirect, incidental, consequential, special, exemplary, or punitive damages.

Nothing in these Terms is intended to limit liability for conduct that cannot legally be limited or excluded, including liability that applicable law does not permit a healthcare provider to disclaim.

These website limitations do not replace, modify, or limit any rights or obligations arising from an actual dentist-patient relationship, applicable professional standards, applicable law, or Backcountry Dental's Notice of Privacy Practices.

19. INDEMNIFICATION

To the extent permitted by applicable law, you agree to be responsible for losses, damages, liabilities, claims, and reasonable expenses arising from your unlawful or unauthorized use of the website or your violation of these Terms.

Nothing in these Terms changes the rights of minors, parents, guardians, or personal representatives under applicable healthcare or privacy laws.
